General terms

The following terms apply to agreements entered with PEPworldwide regarding training, facilitation, and consulting services. The nature, content, and scope of the assignment, as well as its timing and financial aspects, must be agreed upon in advance through an order confirmation or otherwise specified in writing between the parties.

Compensation and payment

PEPworldwide is entitled to compensation based on the agreed-upon, regardless of whether the client feels they have achieved the expected outcome, as results largely depends on participation and engagement. Payment terms are 14 days net, after which interest of 1% per commenced month may be applied. For assignments consisting of multiple separate days, the full program will be invoiced after the first day.

Cancellation and changes

Agreed assignments may be changed or cancelled without charge up to 4 weeks before the start date. Cancellations within 4 weeks is charged with 50%, within 2 weeks with 75% and within 1 week with 100%. Withdrawn or absent participants are not credited, but names may be replaced up to 1 week before start. All changes to the agreed scope and schedule must be made or confirmed in writing.

Force Majeure

Any assignment that must be cancelled due to circumstances beyond PEPworldwide’s control remains valid. Cancelled assignments are to be completed without further delay, as agreed between the parties. If a consultant assigned to a task is unable to carry out the assignment as planned due to illness or other valid reasons, PEPworldwide may, in consultation with the client, assign another consultant to the task.

Intellectual Property Rights

PEPworldwide retains all rights to the PEP concept, including its content, methodology, and format. Materials received or accessed during the program are for the participant’s personal use only and must not be used or distributed, in whole or in part, to individuals who have not participated in a program. Copying or transferring materials to third parties may only occur in explicit agreement with PEPworldwide.

Confidentiality

The client and participants acknowledge that personal information relevant for the assignment may be collected, processed, and stored, but will not be disclosed to third parties in accordance with applicable legislation. Participants have the right, under the General Data Protection Regulation (GDPR), to access their personal data and, if it is incorrect, incomplete, or irrelevant, request corrections or deletions.

PEPworldwide reserves the right, without requiring separate consent, to use the client’s name/logo as well as general information about the collaboration and its results for marketing purposes.
